Draft. These terms say plainly what we have committed to on the rest of this site, and they are the text the Shopify App Store listing points at — but they have not been reviewed by a lawyer. Have them reviewed before the first merchant who is not Koshindo installs the app.
1. What this covers
These terms are the agreement between Bunyawi ("we") and the Shopify merchant who installs the Bunyawi app ("you"). Installing the app means accepting them. If you do not accept them, uninstall it; nothing is charged during the trial.
2. What we provide
- A dashboard, embedded in your Shopify admin, where you design and configure your mobile app.
- iOS and Android applications built from your configuration and your Shopify catalogue.
- Build, signing and store-submission work carried out on your behalf, using access you grant and can revoke.
- Hosting of the API those applications talk to, and delivery of push notifications.
- Support by email, and on the Pro plan a named contact with a same-day reply.
3. What you are responsible for
- Holding your own Apple Developer Program membership and Google Play developer account, in your business's name. We cannot publish under ours: Apple's Review Guideline 4.2.6 forbids it, and it would leave you unable to take your app with you.
- The content of your app — your products, prices, descriptions, images and policies — and its compliance with the law where you sell.
- Answering Apple's App Privacy questionnaire and Google's Data Safety form. We tell you what the app collects; only you can declare it.
- Your store's payment, shipping and tax configuration. Checkout happens in your Shopify checkout, under your Shopify agreement.
- Keeping the access you grant us current, and revoking it if you stop wanting us to have it.
4. Price, billing and the price lock
- Plans are billed monthly through Shopify and appear on your Shopify invoice.
- Every plan starts with a 14-day free trial. Nothing is charged during it.
- The price you subscribe at is your price for as long as your subscription runs without interruption. We will not raise it on an existing subscriber. If we raise list prices, you keep yours.
- There is no revenue share, no per-order fee, no per-install fee and no usage band that moves you between tiers.
- Apple's $99 a year and Google's $25 are paid by you, directly to them. They are not ours and we do not mark them up.
5. Cancelling
Uninstall the app in your Shopify admin. Billing stops that day. There is no notice period, no cancellation form and nobody to email. We do not pro-rate a partial month, and we do not charge for one either.
Your published apps stay in the stores under your own accounts — we never hold the listing, so there is nothing for us to release. Your design and configuration are kept for 30 days in case you come back, then deleted.
6. Who owns what
- Yours: your brand, your catalogue, your content, your customer data, your store listings, and the apps as published under your developer accounts.
- Ours: the Bunyawi platform — the dashboard, the API, the application source code and the build system. Your subscription is a licence to use it, not a transfer of it.
- If you leave, the published apps continue to exist and to show whatever they last cached, but they stop receiving configuration, catalogue and push service from us.
7. Acceptable use
You may not use Bunyawi to sell anything illegal where you operate, to impersonate another business, to build an app that duplicates another merchant's app, or to attempt to access another tenant's data. We may suspend an account that does, and we will tell you why.
8. Service levels and what we do not promise
We aim for the API to be available at all times and we watch it, but we do not offer a contractual uptime percentage or service credits at these prices, and we will not pretend otherwise. We do not control Apple's or Google's review decisions, timelines or policy changes, nor Shopify's platform, nor the delivery of a push notification by Apple's or Google's networks.
We will tell you about planned work that affects you before it happens, and about unplanned outages while they are happening rather than afterwards.
9. Liability
To the extent the law allows, our total liability to you for any claim is limited to the fees you paid us in the three months before the claim arose. We are not liable for lost profit, lost sales or loss of goodwill. Nothing here limits liability for fraud, or for anything that cannot be limited by law.
10. Changes to these terms
We will email every merchant at least 30 days before a change that materially affects your rights takes effect. If you do not accept it, uninstall before it takes effect and nothing further is charged. A change can never retroactively raise the price of an existing subscription.
11. Governing law
These terms are governed by the laws of the Arab Republic of Egypt, and the courts of Cairo have jurisdiction — without affecting any mandatory consumer-protection right you have where you live.
